The Australian Government has introduced far reaching changes to the definition of Member of the Family Unit (MoFU) for the purpose of most visa applications. There are now significant limitations on the class of persons that can be considered part of MoFU and hence be included in a visa application.
Character Assessment of Australian Sponsors of Partner Visa Applications
From 18 November 2016, Australian citizen and permanent resident Sponsors of Partner Visa and Prospective Marriage Visa applications (“a partner visa”), are subject to character testing. In line with current Australian Government strategies to reduce family violence in the Australian community, the new provisions have been introduced to prevent Australians who have committed a relevant offence from being able to sponsor someone for a partner visa.
IT graduate skills now assessable against MODL occupations

Skills assessments are a critical component of skilled migration visa applications.  The skills assessing body for computer professionals, the Australian Computer Society (ACS) has just made a welcome addition to their skills assessment application processes, making it possible for recent IT graduates with Australian qualifications to be assessed in Migration Occupation in Demand List (MODL) occupations. 

Before the new application process was introduced, recent graduates with Australiab qualifications were not eligible to be assessed for MODL occupations as applicants are only assessed by ACS for these occupations where they can show at least 12 months work experience in the occupation.  When assessing recent graduates for a skills assessment, a graduate’s work experience was not considered.  ACS would simply assess a graduate’s Australian qualifications and provide an assessment for the generic occupation Computer Professional (not elsewhere classified).  This meant recent IT graduates with Australian qualifications were unable to obtain bonus points through MODL and could not have their applications fast-tracked by showing that they had skills on the Critical Skills List (CSL).

As some recent graduates do have work experience which would make them eligible for an assessment under MODL, ACS has introduced a new assessment process called “Australian Recent Graduates with Experience”.  For recent Australian graduates to receive a positive skills assessment in a MODL occupation they must meet the following criteria:

  • Have completed a degree in IT in Australia less than 24 months before applying for skills assessment
  • Have been employed full-time in a MODL occupation for 12 months or more

Please note, only employment undertaken after completion of a qualification in IT and/or after completion of a certain amount of work experience, will be counted towards the 12 months of work in a MODL occupation.

Benefits from obtaining a positive skills assessment in a MODL occupation include:

  1. Receiving bonus points in points tested skilled migration, thus improving your chances of reaching thepassmark for the permanent visa you wish to apply for;
  2. Having an occupation that appears on the Critical Skills List, making your application eligible for fast-tracking;
  3. Being eligible for State or Territory Sponsorship in some parts of Australia, which also makes your application eligible for fast-tracking and reduces the passmark for points tested permanent residency visas
